Asianux was doomed.

2005年8月25日，由中國的Red Flag，日本的MIRACLE LINUX和韓國的Haansoft共同推出了Asianux 2.0。

這個新的套件已經有許多人測試過了，包括了有Distrowatch的批判以及OSDir由商業使用者角度的戲謔，對這個新生的套件都不是很看好。

小弟我翻了翻Asianux的網站，後知後覺的打算下載的時候，我看到了令人驚訝不已的授權文字：
為了避免節錄發生問題，我把整篇授權全部複製過來。

Asianux 2.0 Evaluation License Agreement

Please read this document before installing the Software on your computer. This document contains important information about your legal rights and obligations. Installing any or all of the Software indicates that you agree to and will abide by the following terms. If you do not agree to them, please don't install the Software.

License Terms

Miracle Linux Corporation ("Miracle Linux"), Red Flag Software Co., Ltd. ("Red Flag") and Haansoft Inc.("Haansoft") grant you a non-exclusive, non-transferable license to evaluate the Software in accordance with the following terms.
Licensee shall have no right to use the Software.for commercial development purpose or your business operation purpose.

Article 1 Definitions

(1) Asianux2.0 ("Software") is a collective work which consists of hundreds of software components (each, "Component") included in Asianux2.0 Install CD and Asianux2.0 Source CD. "Software" includes without limitation, source code, object code, Documentation, appearance, structure and organization.

(2) "Documentation" refers to README and INSTALLATION file stored in the Software.

(3) "You" and "your" refers to the individual or entity that is granted to use the Software.

(4) "GNU-GPL" that is GNU-General Public License, Version 2, June 1991, Copyright© 1989, 1991 Free Software Foundation, Inc. 59 Temple Place - Suite 330, Boston, MA 02111-1307, USA. For details, please see: http://www.gnu.org/copyleft/gpl.html

Article 2 Restrictions

Each Component has been copyrighted individually and is licensed pursuant to individual license terms included in each Component. Most of Components is licensed pursuant to GNU-GPL which permits you to copy, modify, and redistribute the software, in both source code and binary code forms. You may use each Component only if you agree to individual license terms applicable to each Component and use them within the scope of applicable terms of use. Nothing in this agreement limits your rights under, or grants you rights that supersede, the license terms of each Component.

Article 3 Ownership

(1) The Software is jointly owned by Miracle Linux, Red Flag and Haansoft and protected under copyright and other laws.

這是什麼條款? 看起來像是抄來的, 一般的商業軟體的第一條。

(2) You may make one copy of the Software for backup purpose only. You may not make additional copy of the Software without obtaining authorization from Miracle Linux, Red Flag and Haansoft.

這個更是令人絕倒，你只能夠複製一份作為備份？而且不能在未經三家公司的同意之下複製任何一份。當然包括了Mirror這種我們習以為常的行為模式。

Article 4 Trademarks
"Asianux" is a trademark which is jointly owned by Miracle Linux and Red Flag.In Korea, Haansoft is an applicant for trademark registration of
"Asianux". All other trademarks are the property of their respective owners. You may not use any trademark or logo which belong to Miracle Linux, Red Flag and Haansoft (including "Asianux?? without the prior written authorization from Miracle Linux ,Red Flag and Haansoft.

Article 5 No Warranty
Except as specifically stated in this agreement or in another agreement, the Software is provided and licensed "AS IS" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, non-infringement, and fitness for a particular purpose.

Miracle Linux, Red Flag and Haansoft do not warrant that the functions contained in the Software will meet your requirements or that the operation of the Software will be entirely error free or appear precisely as described in the accompanying documentation.

Article 6 Liability for Damages
It is the party who received the fees you paid for the Software that shall be responsible for any damages arising out of or related to this agreement, whether in contract or tort, even if it is a Software jointly owned.

Article 7 Limitation of Liabilities

(1) To the maximum extent permitted by applicable law, in no event will Miracle Linux, Red Flag and Haansoft be liable to you for any damages, including lost profits or lost savings, or other incidental or consequential damages, arising out of the use or inability to use the Software, even if Miracle Linux, Red Flag and Haansoft had been advised of the possibility of such damages.

(2) The maximum liability of Miracle Linux, Red Flag and Haansoft for any damages arising out of or related to this agreement, whether in contract or tort, even if a court has found Miracle Linux, Red Flag and Haansoft to be liable for the damage, shall be limited to the fees you paid for the Software.

(3).You are responsible for securing a backup copy for your data, Miracle Linux, Red Flag and Haansoft shall not bear any liability whatsoever for any loss of data caused by the Software.

Article 8 Claims for Damages
Any damages arising out of or related to this agreement, whether in contract or tort, shall be separately assumed by and charged directly with the respective party to whom you paid the fees for the Software.

Article 9 Others

(1) You agree to observe and comply with applicable export laws and regulations.

(2) You agree that Miracle Linux, Red Flag and Haansoft are entitled to audit your use of the Software.

這個就更讚了！三家公司隨時可以監控你如何使用這套軟體！

(3) The License Terms supersedes the terms and conditions written in your order form and any other materials related to the said order form.

這一行也很不錯，不管你下訂單的時候拿到的是什麼樣的授權，本授權就是王道，有權可以替代掉任何你購買時的契約內容。

The name and logo of "Asianux" is a trademark of Miracle Linux Corporation and Red Flag Software Co., Ltd. In Korea, Haansoft, Inc. is an applicant for trademark registration of "Asianux".
"Linux" is a registered trademark or a trademark in United States or other countries of Linus Torvalds.
Other names may be trademarks of their respective owners.

總之，小弟看完這個授權條約，就嚇的不敢下載了... Orz

更何況，Distrowatch的評判裡嚴重的警告Asianux的網站很爛、自爽的press release、套件開發的不開放以及超慢的下載速度。

OSDir也提到了這個桌面環境糟透了的解析度、完全的缺乏任何office軟體。

唉... 再次 Orz
